Nevada notary commission

Nevada notary commission: the required course, a county clerk bond and a posted fee table

Complete a training course of at least 3 hours with an exam (NRS 240.018), buy a $10,000 bond and file it with your county clerk, then send the Secretary of State your application with the $35 fee, proof of training and the clerk's certificate. You may not notarize until your certificate of appointment is issued. The term is four years, and the course is required again at every renewal.

Who can be a Nevada notary

  • A Nevada resident, or a resident of an adjoining state who keeps a registered Nevada place of business or is regularly employed at a Nevada office of a Nevada-registered employer (NRS 240.015).
  • 18 or older, with your civil rights.
  • The required training course and exam completed (NRS 240.018).
  • No disqualifying conviction. Some moral-turpitude convictions can be overcome after 10 years under the conditions in NRS 240.010.
  • A signed declaration that no appointment of yours has been revoked or suspended in any state, and fingerprints if asked.

Course, bond, clerk, application

  1. Take the training course. At least 3 hours with an exam, in person or online, from the Secretary of State or an approved vendor (NRS 240.018). The certificate carries a Secretary of State validation stamp and is valid for 90 days (NAC 240.270), so plan the rest within that window.
  2. Buy the $10,000 bond. From a qualified surety company, payable to the State of Nevada.
  3. File the bond and take the oath at the county clerk. Clark and Washoe Counties each charge $20; other counties set their own fee. Washoe gives you a Bond Filing Notice for the Secretary of State.
  4. Send the application to the Secretary of State. With the $35 fee, proof of training and the clerk's certificate (NRS 240.030).
  5. Wait for the certificate of appointment. You may not notarize until it is issued (NRS 240.030(5)). Then order a stamp showing your certificate number.

Electronic and audio-video notarization in Nevada

Audio-video acts are allowed only for notaries with an approved electronic notary registration in active status (NAC 240.645; NRS 240.192). The registration lists your commission number, each solution provider, your electronic seal and signature, and proof of a separate electronic notarization course dated within 90 days.

You must be physically in Nevada, and you and the signer must both consent to audio-video communication. Knowledge-based questions are 5 questions with at least 5 choices each, 80% correct within 2 minutes, with two retries within 48 hours (NAC 240.695). If the connection drops, restart the act, including the identity checks.

No fee without a posted fee table

Nevada notaries may not charge any fee unless a fee table is posted in their office in type no smaller than 1/2 inch (NRS 240.100). The caps: $15 for the first signature on an acknowledgment and $7.50 for each additional one, $15 per jurat signature, $7.50 for an oath or a certified copy. Travel is $15 an hour from 6 a.m. to 7 p.m. and $30 an hour overnight, with a 2-hour minimum, only if the client asked for travel and agreed to the rate in advance.

A journal is required for every act, in a bound volume with preprinted page numbers (NRS 240.120), kept 7 years after you stop being a notary. The stamp is a rectangle no larger than 1 by 2 1/2 inches with your name, "Notary Public, State of Nevada", your expiration date and certificate number (NRS 240.040).

Nevada notary questions

Do I take the Nevada notary course again to renew?

Yes. The training course and exam are required for first-time applicants and for every renewal (NRS 240.018).

How long is a Nevada training certificate good for?

90 days (NAC 240.270), so file your bond and application within that window.

Where do I file my Nevada notary bond?

With your county clerk, where you also take the oath. Clark and Washoe Counties charge $20 each; other counties set their own fee.

Can I charge for notarizing before I post a fee table?

No. NRS 240.100 bars charging any fee unless the table is posted in your office in type at least 1/2 inch tall.

Can I be a Nevada notary if I live in California or Arizona?

Possibly. A resident of an adjoining state qualifies with a registered Nevada place of business or regular employment at a Nevada office of a Nevada-registered employer (NRS 240.015). The stamp then adds "nonresident".
