Online notarization for signers in Delaware

A commissioned New Jersey notary can notarize for you by secure video while you're in Delaware. Below: the Delaware law on out-of-state notarizations, and who has the final word.

Will Delaware accept a New Jersey online notarization? Generally, yes. Delaware law recognizes notarial acts performed in other states (29 Del. C. §4324 (Laws of Delaware, Vol. 83, Ch. 425)). The county Recorder of Deeds or whoever receives your document still decides what it accepts.

What Delaware law says

Delaware's notary law, rewritten in 2022 by Senate Bill 262, says a notarial act performed in another state has the same effect under Delaware law. (29 Del. C. §4324 (Laws of Delaware, Vol. 83, Ch. 425))

On our side, New Jersey law treats an online notarization by a New Jersey notary as performed in New Jersey, wherever the signer is (N.J.S.A. 52:7-10.10).

Who decides in Delaware

We didn't find an official Delaware page that adds requirements for out-of-state or electronic notarizations. That isn't a promise there are none. The county Recorder of Deeds, agency, court or company receiving your document decides what it accepts, so ask them before you book.

Delaware's own online notaries

Under the same act, Delaware notaries could ask for remote or electronic privileges starting August 1, 2023, using technology the state's Notary Public office approves. (source) That's context: it governs Delaware notaries, not ours.

Before you book

  • Ask the county Recorder of Deeds (for property) or the office receiving your document whether it takes an electronically notarized document or a printed copy of one.
  • Have a current government photo ID and the complete, unsigned document as a PDF.
  • Online sessions run 7 a.m. to 9 p.m. Eastern time, 7 days a week, by appointment.
  • Outside the U.S.? We can notarize for you when the document is for a U.S. court or agency, involves U.S. property, or relates to a transaction connected with the U.S., and signing isn't prohibited where you are. Check your document.
  • Commonly notarized online from Delaware: Corporate and LLC paperwork, affidavits, and powers of attorney.

Questions

Did Delaware's 2023 notary changes touch out-of-state notarizations?

Yes. The act that opened remote privileges to Delaware notaries on August 1, 2023 is the same one that contains §4324, which gives a notarial act performed in another state the same effect in Delaware.

Is a New Jersey online notarization valid in Delaware?

Generally, yes. Delaware law recognizes notarial acts performed in other states (29 Del. C. §4324 (Laws of Delaware, Vol. 83, Ch. 425)). The county Recorder of Deeds or whoever receives your document still decides what it accepts. We are not lawyers, so for anything high-stakes, ask the receiving office or your attorney.
