Online notarization for signers in Minnesota

A commissioned New Jersey notary can notarize for you by secure video while you're in Minnesota. Below: the Minnesota law on out-of-state notarizations, and who has the final word.

Will Minnesota accept a New Jersey online notarization? Generally, yes. Minnesota law recognizes notarial acts performed in other states (Minn. Stat. §358.61). The county recorder or whoever receives your document still decides what it accepts.

What Minnesota law says

Minnesota gives a notarial act performed in another state the same effect as if a Minnesota notarial officer performed it, when a notary public of that state does it (2018 c 176). (Minn. Stat. §358.61)

On our side, New Jersey law treats an online notarization by a New Jersey notary as performed in New Jersey, wherever the signer is (N.J.S.A. 52:7-10.10).

Who decides in Minnesota

We didn't find an official Minnesota page that adds requirements for out-of-state or electronic notarizations. That isn't a promise there are none. The county recorder, agency, court or company receiving your document decides what it accepts, so ask them before you book.

Minnesota's own online notaries

Minnesota's remote online notaries act under Minn. Stat. §358.645, which ties their authority to being physically located in Minnesota. (source) That's context: it governs Minnesota notaries, not ours.

Before you book

  • Ask the county recorder (for property) or the office receiving your document whether it takes an electronically notarized document or a printed copy of one.

Is a New Jersey online notarization valid in Minnesota?

Generally, yes. Minnesota law recognizes notarial acts performed in other states (Minn. Stat. §358.61). The county recorder or whoever receives your document still decides what it accepts. We are not lawyers, so for anything high-stakes, ask the receiving office or your attorney.
