Online notarization for signers in Montana

A commissioned New Jersey notary can notarize for you by secure video while you're in Montana. Below: the Montana law on out-of-state notarizations, and who has the final word.

Will Montana accept a New Jersey online notarization? Generally, yes. Montana law recognizes notarial acts performed in other states (MCA 1-5-605(1)). The county clerk and recorder or whoever receives your document still decides what it accepts.

What Montana law says

Montana gives a notarial act performed in another state by a qualifying officer the same effect as if a Montana notarial officer performed it. (MCA 1-5-605(1))

On our side, New Jersey law treats an online notarization by a New Jersey notary as performed in New Jersey, wherever the signer is (N.J.S.A. 52:7-10.10).

Who decides in Montana

We didn't find an official Montana page that adds requirements for out-of-state or electronic notarizations. That isn't a promise there are none. The county clerk and recorder, agency, court or company receiving your document decides what it accepts, so ask them before you book.

Montana's own online notaries

Montana notaries may perform remote notarizations while physically in Montana, for signers in Montana, elsewhere in the U.S., or abroad under conditions (MCA 1-5-603(10)), after notifying the Secretary of State (1-5-615(3)). (source) That's context: it governs Montana notaries, not ours.

Before you book

  • Ask the county clerk and recorder (for property) or the office receiving your document whether it takes an electronically notarized document or a printed copy of one.

  • Online sessions run 7 a.m. to 9 p.m. Eastern time, 7 days a week, by appointment.

Questions

Montana's section mentions 'reciprocity.' What does that mean here?

The section title covers both directions. Subsection (1) gives another state's act the same effect in Montana; subsection (4) is about Montana notaries acting in bordering states, which isn't what we do.

Is a New Jersey online notarization valid in Montana?

Generally, yes. Montana law recognizes notarial acts performed in other states (MCA 1-5-605(1)). The county clerk and recorder or whoever receives your document still decides what it accepts. We are not lawyers, so for anything high-stakes, ask the receiving office or your attorney.
