Online notarization for signers in South Carolina

A commissioned New Jersey notary can notarize for you by secure video while you're in South Carolina. Below: the state law on out-of-state notarizations, and who has the final word.

Will South Carolina accept a New Jersey online notarization? Generally, yes. The state law accepts notarial certificates made in other jurisdictions (S.C. Code §26-1-120(G)). The county register of deeds or whoever receives your document still decides what it accepts.

What South Carolina law says

The state says a notarial certificate made in another jurisdiction is sufficient in the state when it meets the law of the place where it was made. (S.C. Code §26-1-120(G))

On our side, New Jersey law treats an online notarization by a New Jersey notary as performed in New Jersey, wherever the signer is (N.J.S.A. 52:7-10.10).

Who decides in South Carolina

We didn't find an official South Carolina page that adds requirements for out-of-state or electronic notarizations. That isn't a promise there are none. The county register of deeds, agency, court or company receiving your document decides what it accepts, so ask them before you book.

South Carolina's own online notaries

The state's Code defines personal appearance as physical presence (§26-1-5(13)), and the 2021 Electronic Notary Public Act said online applications would wait until rules were in effect and vendors approved. (source) That's context: it governs South Carolina notaries, not ours.

Before you book

  • Ask the county register of deeds (for property) or the office receiving your document whether it takes an electronically notarized document or a printed copy of one.
  • Have a current government photo ID and the complete, unsigned document as a PDF.
  • Online sessions run 7 a.m. to 9 p.m. Eastern time, 7 days a week, by appointment.
  • Outside the U.S.? We can notarize for you when the document is for a U.S. court or agency, involves U.S. property, or relates to a transaction connected with the U.S., and signing isn't prohibited where you are. Check your document.
  • Commonly notarized online from the state: Affidavits, powers of attorney and personal documents, after the receiving office confirms.

Questions

South Carolina notaries can't work by video yet, can they?

We describe only what the Code says: physical presence for South Carolina notaries, and an electronic notary law waiting on rules and vendors. That's separate from §26-1-120(G), which accepts a certificate made in another jurisdiction under that jurisdiction's law.

Is a New Jersey online notarization valid in South Carolina?

Generally, yes. The state law accepts notarial certificates made in other jurisdictions (S.C. Code §26-1-120(G)). The county register of deeds or whoever receives your document still decides what it accepts. We are not lawyers, so for anything high-stakes, ask the receiving office or your attorney.
