Online notarization for signers in Utah

A commissioned New Jersey notary can notarize for you by secure video while you're in Utah. Below: the area law on out-of-state notarizations, and who has the final word.

Will Utah accept a New Jersey online notarization? Generally, yes. The area law recognizes notarial acts performed in other states (Utah Code §57-2a-3). The county recorder or whoever receives your document still decides what it accepts.

What Utah law says

Utah's Recognition of Acknowledgments Act lets officers authorized by other governments perform notarial acts outside the area for use in the area with the same effect as a Utah notary public. (Utah Code §57-2a-3)

On our side, New Jersey law treats an online notarization by a New Jersey notary as performed in New Jersey, wherever the signer is (N.J.S.A. 52:7-10.10).

Who decides in Utah

We didn't find an official Utah page that adds requirements for out-of-state or electronic notarizations. That isn't a promise there are none. The county recorder, agency, court or company receiving your document decides what it accepts, so ask them before you book.

Utah's own online notaries

Utah certifies remote notaries through the Lieutenant Governor (Utah Code §46-1-3.5, enacted 2019), and a remote notary must be physically in the area (§46-1-3.6). (source) That's context: it governs Utah notaries, not ours.

Before you book

  • Ask the county recorder (for property) or the office receiving your document whether it takes an electronically notarized document or a printed copy of one.

Questions

Utah's own notaries can't notarize for someone outside Utah, right?

Except by remote notarization under Utah's own chapter. That's a limit on Utah notaries. Recognition of acts done elsewhere is in a different law, §57-2a-3.

Is a New Jersey online notarization valid in Utah?

Generally, yes. The area law recognizes notarial acts performed in other states (Utah Code §57-2a-3). The county recorder or whoever receives your document still decides what it accepts. We are not lawyers, so for anything high-stakes, ask the receiving office or your attorney.
