Power of attorney for India, signed in New Jersey
Whether it's selling a flat, collecting rent or handling an inheritance, a relative in India usually needs a power of attorney from you. Here's how to sign it in New Jersey so it's accepted there.
Two ways to sign it
- Notary + New Jersey apostille. The Consulate General of India in New York says an apostille makes a US document valid in India without further attestation. (Consulate of India)
- Consulate attestation. The New York consulate attests general powers of attorney, through VFS Global, which has an office in Edison. You'll need proof that you live in the consulate's area.
The 3-month rule in India
A power of attorney signed outside India has to be stamped in India within 3 months of first arriving there, under the Indian Stamp Act. After that, the Collector can't stamp it. Stamp duty is set by each state. Send it soon after it's signed, and tell your relative to stamp it right away. (Indian Stamp Act)
Common reasons it gets refused
- A photocopy, or an apostille taken off the document
- Stamping in India after the 3-month window
- Wording the local registrar or bank doesn't accept; have an Indian lawyer prepare it
Some local offices still ask for consular attestation even with an apostille. Ask the registrar or bank that will use it before you choose a route.
