Florida Executor Kit: First 30 Days, Summary Administration, Creditor Deadlines and Logs

Florida doubled its summary administration limit to $150,000 on July 1, 2026, and whoever holds the original will has 10 days to deposit it with the clerk. This kit puts both, and the creditor deadlines, in order.

Who it is for

Personal representatives named in a Florida will, and family members deciding between summary administration, full administration or none for a Florida estate.

Not the right fit if

The estate is being settled outside Florida, or a disputed will or contested claim means you need a Florida probate attorney.

Why it is different

  • Covers the other July 1, 2026 changes: $5,000 income tax refunds, $2,000 qualified accounts, $20,000 intestate personal property and safe deposit box access.
  • Built from the 2026 Florida Statutes and the Senate's summary of CS/HB 1337.
  • Says where counties differ: the summary steps come from Palm Beach County's July 2026 packet.

What is inside

  • First 30 days. Death certificates, Social Security, and depositing the original will with the clerk within 10 days of learning of the death (s. 732.901).
  • Florida probate paths. Summary administration (s. 735.201), disposition without administration (s. 735.301) and full administration (chapter 733), with the 15th Judicial Circuit's summary packet steps.
  • Florida tax status. No Florida estate tax for deaths after December 31, 2004, and no DR-312 or DR-313 affidavit required from personal representatives since July 1, 2023.
  • Creditor deadlines and log. Claims due 3 months after first publication, or 30 days after service when that's later (s. 733.702), and the 2-year bar in s. 733.710, with a claims log.
  • Asset and debt inventory. Everything owned and owed, totaled against the $150,000 summary administration limit after property exempt from creditors.
  • Distribution log. What each beneficiary received, with a receipt and release for the estate's attorney to review first.
  • Inventory and distribution workbook (Excel). Works out the 3-month claim date from first publication and the 2-year bar from the date of death.

Questions

Common questions

What do I get and how is it delivered?

The FL Executor Kit comes as a zip with six documents, each as an editable Word file and a printable PDF: First 30 Days, Florida Probate Paths, Florida Tax Status, Creditor Deadlines and Log, Asset and Debt Inventory, and Distribution Log, plus an Excel workbook (FL Estate Inventory and Distribution Workbook). The download link arrives by email after payment.

Will it open on a Mac, Google Sheets or my phone?

The PDFs open in any PDF reader, and the Word files edit in Word, Google Docs or LibreOffice. The workbook is built for Excel and tested in LibreOffice; it should open in Google Sheets, but not every feature is tested there. If a file will not open or something looks wrong, reply to your order email and we will make it right.

Is this legal or tax advice?

An organizer, not legal, tax or financial advice. Probate rules are complex; talk to the court clerk or an attorney.

What is Florida's summary administration limit?

$150,000 since July 1, 2026, up from $75,000, measured on the estate subject to administration in Florida less property exempt from creditors' claims. It's also available when the person has been dead more than 2 years. Ask the clerk which limit applies to your filing.
