Who it is for

Executors named in a New York will, and distributees asking the Surrogate's Court for letters of administration when there is no will.

Not the right fit if

The person's primary residence wasn't in New York, or family members are contesting the will or the appointment and you need an attorney.

Why it is different

  • Built from the New York courts' CourtHelp pages and the Tax Department's estate tax page, checked November 2026.
  • Notes that the small estate petition carries a $1 filing fee and works with or without a will.
  • Says where it stops: creditor claim periods weren't confirmed on an official page, so it sends you to the clerk.

What is inside

  • First 30 days. Death certificates, Social Security, securing the home and finding the will before filing with the Surrogate's Court in the county of primary residence.
  • Surrogate's Court steps. Probate, administration or small estate (voluntary administration), the documents each needs, citations or waivers for distributees, bonds and appointment.
  • NY estate tax check. Basic exclusion amounts from 2019 to 2026, who files ET-706, the 9-month due date and ET-133 extensions.
  • Notices and claims log. Citations or waivers, notice to beneficiaries named in the will, the ET-706 date, Form 1041, and a log for every bill and claim.
  • Asset and debt inventory. Everything owned and owed, flagging real property in the person's name alone, which rules out the small estate route.
  • Distribution log. What each distributee received, with a receipt and release to sign.
  • Inventory and distribution workbook (Excel). Dates from the date of death, plus the estate value the Surrogate's Court filing fee is based on.

Questions

Common questions

What do I get and how is it delivered?

The NY Executor Kit comes as a zip with six documents, each as an editable Word file and a printable PDF: First 30 Days, Surrogates Court Steps, NY Estate Tax Check, Notices and Claims Log, Asset and Debt Inventory, and Distribution Log, plus an Excel workbook (NY Estate Inventory and Distribution Workbook). The download link arrives by email after payment.

Will it open on a Mac, Google Sheets or my phone?

The PDFs open in any PDF reader, and the Word files edit in Word, Google Docs or LibreOffice. The workbook is built for Excel and tested in LibreOffice; it should open in Google Sheets, but not every feature is tested there. If a file will not open or something looks wrong, reply to your order email and we will make it right.

Is this legal or tax advice?

An organizer, not legal, tax or financial advice. Probate rules are complex; talk to the court clerk or an attorney.

Does owning a house rule out a New York small estate?

If the person owned a house or land in their name alone, yes. Only personal property counts toward the $50,000 limit, and jointly owned real property doesn't disqualify the estate. Confirm the current amount with the Surrogate's Court clerk.
