Texas Executor Kit: First 30 Days, Small Estate Affidavit, Muniment of Title, Creditor Notices and Logs
Texas offers three routes: a small estate affidavit when there's no will, probate as a muniment of title, or independent administration. This kit helps you pick one and meet its notice dates.

Who it is for
Executors named in a Texas will, and heirs settling a Texas estate without a will who may qualify for the small estate affidavit.
Not the right fit if
The estate isn't being probated in Texas, or a dispute over the will or among heirs needs a Texas probate attorney.
Why it is different
- Built from the Texas Estates Code and Tarrant County Probate Court No. 2's Guide for Independent Executors (2025).
- Explains the small estate affidavit's limits: intestate only, two disinterested witnesses, and no real property except a sole homestead.
- Notes the guide's advice to keep the estate open at least six months from qualification.
What is inside
- First 30 days. Death certificates, Social Security, finding the will, and the 30-day wait before a small estate affidavit when there is no will.
- Texas probate paths. Estates Code chapter 205 affidavits, chapter 257 muniment of title with its 180-day affidavit, and independent administration deadlines.
- Texas tax status. The Texas inheritance tax repeal effective September 1, 2015, and where to check federal Form 706 and 1041 rules.
- Creditor notices and log. Published notice within 1 month of qualifying, certified-mail notice to secured creditors within 2 months, beneficiary notice within 60 days, and a claims log.
- Asset and debt inventory. Everything owned and owed, with the $75,000 small estate test that leaves out the homestead and exempt property.
- Distribution log. What each heir received, or the muniment of title route when the only unpaid debt is secured by a lien on real estate.
- Inventory and distribution workbook (Excel). Texas notice, inventory and muniment of title dates, worked out from the date of death and the qualification date.

Questions
Common questions
What do I get and how is it delivered?
The TX Executor Kit comes as a zip with six documents, each as an editable Word file and a printable PDF: First 30 Days, Texas Probate Paths, Texas Tax Status, Creditor Notices and Log, Asset and Debt Inventory, and Distribution Log, plus an Excel workbook (TX Estate Inventory and Distribution Workbook). The download link arrives by email after payment.
Will it open on a Mac, Google Sheets or my phone?
The PDFs open in any PDF reader, and the Word files edit in Word, Google Docs or LibreOffice. The workbook is built for Excel and tested in LibreOffice; it should open in Google Sheets, but not every feature is tested there. If a file will not open or something looks wrong, reply to your order email and we will make it right.
Is this legal or tax advice?
An organizer, not legal, tax or financial advice. Probate rules are complex; talk to the court clerk or an attorney.
When can I use a Texas small estate affidavit?
Only when the person died without a will, 30 days have passed, no petition for a personal representative is pending or granted, and assets other than the homestead and exempt property are worth no more than $75,000. Two disinterested witnesses and each distributee swear to it.
