What changed
New Jersey's Revised Uniform Law on Notarial Acts took effect in 2021 and the State Treasurer's rules followed in 2022. They allow remote notarization of both paper and electronic records. The signer can be anywhere, but the notary has to be physically in New Jersey, hold an active commission and have notified the State Treasurer before the first remote act.
What you need
A computer, tablet or phone with a camera, a microphone and a steady internet connection. A government-issued photo ID. A quiet, well-lit spot. The document itself, either as a file you upload or as paper you mail to the notary, depending on the type of remote notarization.
How identity is checked
The notary may know the signer personally or use the identity proofing methods the state rules require. In practice that means the notary sees you on live video, you show your ID to the camera, and the platform may add credential analysis or knowledge-based questions. Have the ID you used to sign up in your hand.
The session
The notary confirms who you are and where you are, asks whether you are signing willingly, and watches you sign. For an electronic document you sign on screen. For a paper document you sign in view of the camera and send it afterward if the process requires. The notary then completes the notarial certificate and records the act in a journal and keeps the audio-video recording.
When remote may not work
The person or agency receiving the document has to accept a remote notarization. Some out-of-state recipients, courts, banks and foreign authorities have their own rules, and some documents for use abroad need an apostille after the notarization. Ask the recipient first.
Ink-signed vs. electronic
With an electronic notarization the entire document stays digital. With remote ink-signed notarization you sign on paper and the notary completes the notarization after seeing you sign. Which one fits depends on what the recipient accepts.
Common questions
Is a remote notarization legally the same as an in-person one?
In New Jersey, a notarial act performed under the law has the same effect as one performed in person, if the recipient accepts it.
Do I need to be in New Jersey?
No. The notary has to be physically in New Jersey, but the signer can be elsewhere. Check that the document's destination accepts it.
Can a will be signed remotely?
Wills have their own rules for witnesses and execution. Ask an estate attorney before relying on any remote signing for a will.
