Purpose of the affidavit
The person signing, usually the heir or successor, swears that the estate is below the local limit, that a required waiting period has passed, that no probate case is open, and that they are entitled to the property. The bank or agency holding the property then releases it.
Do not rely on a general article for limits. Look up the court's current rules.
Information to collect
You will need the deceased's full name, date and place of death, a list of assets with approximate values, the heirs' names and shares, and a certified death certificate. Some forms ask for the sum of debts and funeral costs.
Make sure every number you write is accurate, because the affidavit is sworn.
At the notary table
The affiant shows ID, swears an oath, and then signs under the notary's eye. The notary completes the jurat. If several heirs sign, each appears. The notary does not review the asset list or tell you if the estate qualifies.
If the form must be filed with a court, check whether the clerk wants originals.
How institutions react
Banks, motor vehicle offices and investment firms may have their own forms or may ask for extra proof. Call them before you start. Some will only accept the court's version of the affidavit. Others require a copy of the death certificate with a raised seal.
Keep a log of who you contacted and what each asked for.
Cautions
Signing a false statement under oath can have consequences. If the family is in conflict, if there is real estate, or if the estate may owe taxes, ask an attorney before signing. Some assets pass outside probate through named beneficiaries.
A notary can handle the signing but not the advice.
Scenario: closing a modest bank account
A daughter wants to close her late father's checking account. The bank asks for a certified death certificate and its own form of small estate affidavit. She fills it in, listing her father's assets and the heirs, and signs before a notary.
The bank accepts the affidavit after reviewing it and releases the balance to her. A vehicle, though, requires a different agency form. A small retirement account may already have a named beneficiary and need neither.
The lesson is to sort each asset by how it passes. Accounts with named beneficiaries, jointly owned property and items in a trust often skip the affidavit route. A short call to each institution tells you which forms apply, and an attorney can confirm.
One more useful step is to organize the paperwork into a single folder: death certificates, account statements, a list of contacts at each institution, and copies of the signed affidavits. When several asset holders request originals, plan to make multiple notarizations and ask the notary to stamp more than one copy. Keep track of which institution has received which version and when.
Mistakes that get documents rejected
Signing before reading, leaving fields blank and using the wrong form are common. Institutions often have their own forms. The notary does not decide whether an estate qualifies or what the affidavit should say.

Ask the institution which form it accepts. Gather ID and the death certificate if required. Fill in the facts you can verify. Sign in front of the notary.
