Why acknowledgment is common
Many places require or recommend that a prenup be signed in a way that proves identity and free choice. An acknowledgment before a notary offers that. The attorney will tell you which certificate and which witnesses are needed.

Timing
Signing on the day before a wedding invites later challenges that the signer felt rushed. Attorneys often suggest signing well ahead of the wedding. This is guidance for you and your lawyer, not something the notary decides.

At the signing
Both parties may sign together or separately. Each presents ID, signs where indicated and confirms the signature. The notary completes a separate acknowledgment for each. Exhibits listing assets should be attached before signing, not later.

Independence matters
The notary may ask whether anyone is pressuring the signer. If one partner or a parent insists on speaking for the signer, the notary may pause. A calm, unhurried session supports the validity of the paper, though only a court can decide that.

After signing
Each party should keep a complete copy. The attorneys usually hold the original. If circumstances change, such as moving to a new place, ask the attorney whether the prenup needs review.
A prenup does not replace a will or beneficiary forms.
Scenario: a business owner and a future spouse
A business owner wants to protect the company in the event of a divorce. His partner has her own attorney. Several weeks before the wedding, the lawyers exchange drafts and both parties read the final terms.
At signing, the couple meets at the attorney's office. A notary attends, the two attorneys sit in, and each party signs in turn. The notary completes an acknowledgment for each. Financial disclosure schedules are attached beforehand and initialed.
Afterward, each party receives a full copy and the attorneys hold the original. Months later the owner updates his will and beneficiary forms with his lawyer. These steps work together, which is why a prenup is part of broader planning rather than a stand-alone paper.
Put the ID check on your calendar. An expired license or a name that differs from the draft can force a rescheduled appointment, which is unwelcome when a wedding date is near. Confirm names as they should appear, including any middle names, with your attorney, and make sure both partners carry unexpired government photo ID to the signing. Ask about storage. A prenup does nothing if no one can find it when needed. The attorneys may keep the original, and each partner can keep a copy in a secure but reachable place. Tell trusted family members where to look, and note it in your estate planning folder.
