What the notary looks for
The notary wants to see that the signer knows who they are, can follow the conversation, understands in general terms that they are signing a document, and is not being forced. A notary is not a doctor and does not diagnose. The test is simple, practical observation.
If a signer seems unable to answer basic questions, the notary may decline.
Questions you may hear
Examples are: Can you tell me your name and today's date? What document are we signing? Who asked you to sign? Do you want to sign it? These are not trick questions. Answers do not need to be perfect, but they should show real awareness.
A signer who forgets the exact name of the document but explains its purpose in plain words is usually fine.
Role of family members
Family can help with scheduling, ID and transport. When the notary asks questions, let the signer answer. The notary may ask others to leave the room briefly. This is a standard way to confirm that the signer's choices are their own.
If a person who benefits from the document is also the one coordinating the appointment, the notary may be more careful.
Picking the right time
Morning visits may suit people who tire later. Avoid times right after medication changes or procedures. Arrange for glasses, hearing aids and a good light. Offer a drink and a calm space.
Bring valid ID. If the license is expired, ask the notary what other IDs may work.
If the notary declines
A refusal is not an accusation. It means the notary could not be sure. Families can ask the signer's doctor or an attorney about other steps, such as a capacity assessment or court procedure.
Never push a notary to proceed. Doing so risks the validity of the document and the signer's safety.
Scenario: a signing at an assisted living facility
A resident wants to sign a new healthcare proxy. Her daughter schedules a notary at the facility's activity room at ten in the morning. The notary greets the resident, asks about her day and then asks what she would like to sign and why.
The resident explains in her own words that she wants her niece as her agent. The notary asks the daughter to wait outside, then confirms with the resident alone that no one is pressing her. The resident signs, and the notary completes the certificate.
Facility staff may also have rules, such as visiting hours or requirements for visitors to check in. Call ahead, give the notary's name, and ask whether staff can provide a table and good lighting. Small touches like these help a signer feel at ease.

Can a notary refuse because of age?
No. The decision is based on awareness and willingness, not age.
Do I need a doctor's letter?
Not for a routine notarization, though an attorney might request one for estate documents.
Can a family member sit in?
Possibly, though the notary might request a private word with the signer.
