Reading the table
- Limit is the most a landlord may ask for as a deposit, in months of rent unless noted. Some states count prepaid rent or pet deposits toward it.
- Return deadline is counted from the event the statute names, usually the end of the tenancy or the move-out, sometimes the date the landlord gets a forwarding address.
- Itemized statement is what has to go to the tenant with any partial refund.
- Where held covers account rules and any notice to the tenant about the bank.
- Penalty in the text is what the statute itself says a court may award. Whether it applies is for a court to decide.
Where a legislature's site didn't load for us, the row cites a state agency's guide instead (for example the Connecticut Department of Banking, the New Jersey Department of Community Affairs or the Texas State Law Library). Rows with a dated source carry a note asking you to confirm against the current statute.
Organizer information checked November 2026 against the official pages linked for each state, not legal advice. It doesn't decide what applies to a particular lease or deposit: city and county ordinances, the lease itself and later amendments can change the answer. Where a fact isn't confirmed from official text, the page says so and names where to check. Anything entered in the calculator stays in your browser.
Common questions
How long does a landlord have to return a security deposit?
It depends on the state. In the 49 jurisdictions whose deadline we confirmed from official text, the calendar-day deadlines run from 14 days (Alaska, Hawaii, Nebraska, New York, Vermont) to 60 days (Alabama, Arkansas, West Virginia). Arizona counts 14 business days, and Louisiana counts one month. Several states start the clock only after the tenant gives a forwarding address.
Is there a limit on how much a security deposit can be?
Many states cap it, usually at one to two months' rent, and some add rules for pets, furnished units or older tenants. Florida, Illinois, Kentucky, Minnesota, Ohio, Oregon, South Carolina, Utah, Vermont, Washington and West Virginia have no limit in the sections we read. The table shows each state's figure or says it isn't confirmed.
Does the landlord have to pay interest on a deposit?
Only in some states, and the rules differ. Connecticut uses a rate the Banking Commissioner sets each year (0.49% for 2026), Massachusetts uses 5% or the bank's lower rate, Minnesota 1%, and Ohio 5% on part of the deposit. New Jersey, Pennsylvania and North Dakota give the tenant the account's interest under their own conditions.
What has to come with a partial refund?
Almost every state we confirmed requires a written, itemized list of what was deducted and why, sent within the deadline. Some add more: receipts over $125 in California, a sworn list in Massachusetts, certified mail in Florida and New Jersey.
What if a state says 'Not confirmed'?
We list a fact only when an official page we opened in November 2026 states it. Where a legislature site couldn't be read or the official text didn't cover the point, the row says so and names where to check. Your city or county may also have its own deposit rules.
